1. Introduction and Acceptance of Terms

1.1. Welcome to AstroBestie! The AstroBestie mobile application ("App") is developed and published by Digital App Group GmbH ("we", "us", "our", or "Digital App Group"), a company incorporated in Germany.

1.2. By downloading, accessing, or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, you must not download, access, or use the App.

1.3. We may update these Terms from time to time. We will notify you of any material changes, and by continuing to use the App after such changes, you agree to the revised Terms.

2. Use of the App

2.1. AstroBestie is designed to provide astrological guidance and advice. It is intended for entertainment purposes only and should not be used as a substitute for professional or personal advice.

2.2. The App is available to users who are at least 13 years of age. If you are under 13, you must not use the App without obtaining parental or guardian consent.

3. Account Registration

3.1. To access certain features of the App, you may need to create an account. You agree to provide accurate and complete information when creating an account and to keep this information updated.

3.2. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.

4. Intellectual Property Rights

4.1. All content, including but not limited to graphics, logos, text, images, audio clips, digital downloads, data compilations, and software, is the property of Digital App Group or its content suppliers and is protected by international copyright laws.

4.2. The AstroBestie name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Digital App Group or its affiliates. You must not use such marks without the prior written permission of Digital App Group.

5. Prohibited Use

5.1. You agree not to use the App:

• For any unlawful purpose or to promote any illegal activity.

• To send, knowingly receive, upload, or download any material that does not comply with these Terms.

• To impersonate or attempt to impersonate Digital App Group or an AstroBestie employee, or another user.

5.2. We reserve the right to terminate or suspend your access to the App if, in our sole discretion, you violate any of these prohibitions.

6. Disclaimers

6.1. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or usefulness of the App's content. Any reliance on such content is strictly at your own risk.

6.2. Astrological advice and guidance provided by the App are for entertainment purposes only. You should not make any life decisions based on such advice.

7. Limitation of Liability

7.1. To the fullest extent permitted by law, Digital App Group, its affiliates, licensors, service providers, employees, agents, officers, and directors shall not be liable for any damages of any kind arising from the use of the App or reliance on its content.

7.2. Digital App Group is not responsible for any technical malfunctions, interruptions, or failures related to the App.

8. User Content and Conduct

8.1. The App may allow users to post, submit, or share content, including but not limited to feedback, comments, and suggestions ("User Content").

8.2. By posting User Content, you grant Digital App Group a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods.

8.3. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third-party rights, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights.

8.4. All User Content must comply with applicable laws and regulations. You agree not to post content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.

• Contains promotional material, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.

8.5. Digital App Group has the right, but not the obligation, to monitor and remove any User Content that we find in violation of these Terms or for any other reason.

9. Third-party Links and Services

9.1. The App may contain links to third-party websites or services that are not owned or controlled by Digital App Group.

9.2. Digital App Group has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. By using the App, you expressly relieve Digital App Group from any and all liability arising from your use of any third-party website or services.

9.3. We encourage you to be aware when you leave the App and to read the terms and conditions and privacy policy of each third-party website or service that you visit or use.

10. Termination

10.1. We may terminate or suspend access to the App without prior notice or liability for any reason whatsoever, including, without limitation, if you breach the Terms.

10.2. Upon termination, your right to use the App will immediately cease. All provisions of the Terms which by their nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability, shall survive termination.

11. Indemnification

11.1. You agree to defend, indemnify, and hold harmless Digital App Group, its parent company, officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App, or your violation of these Terms.

12. Governing Law and Jurisdiction

12.1. These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

12.2. You agree that any dispute arising from or relating to the subject matter of these Terms shall be governed by the exclusive jurisdiction and venue of the courts of Germany.

13. Changes to the Terms

13.1. Digital App Group reserves the right to revise and update these Terms at any time. Changes will be effective immediately upon posting of the revised Terms in the App, and your continued use of the App thereafter means that you accept those changes.

13.2. It is your responsibility to check the App regularly for changes to these Terms.

14. Data Privacy and Protection

14.1. Any information we collect during your use of the App, including registration and any User Content, is subject to our Privacy Policy. By using the App, you consent to all actions we take concerning your information consistent with our Privacy Policy.

15. Severability

15.1. If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.

16. Waiver

16.1. No waiver of any provision of these Terms by Digital App Group shall be deemed a further or continuing waiver of such provision or any other provision, and any failure by Digital App Group to assert any right or provision under these Terms does not constitute a waiver of such right or provision.

17. Notifications

17.1. We may provide notifications to you as required by law or for marketing or other purposes via (at its option) email to the primary email associated with your account, mobile notifications, or hard copy. Digital App Group reserves the right to determine the form and means of providing notifications.

19. Entire Agreement

19.1. These Terms, together with any policies or operating rules posted by us on the App or in respect to the App, constitute the entire agreement and understanding between you and Digital App Group. They govern your use of the App, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Digital App Group (including, but not limited to, any prior versions of the Terms).
